New York State Senator Tom Duane says he’s gotten commitments from at least 32 of his colleagues, which is the number of votes necessary to pass a pending marriage equality bill, according to the New York Daily News.

But Duane, the openly gay senator who’s managing the bill, isn’t naming names, and others who’ve polled the senate say only 20 are publicly on board.

The Albany Times-Union reported on the bill’s status this way:

The measure was passed by a large margin in the state Assembly last month but awaits action in the Senate. On Monday, Senate Majority Leader Malcolm Smith’s spokesman reiterated the Democrat’s belief that the measure still lacks the 32 votes necessary for passage. Smith has consistently said he would not bring the measure to the floor just to see it die.

But that somewhat pessimistic expression was contradicted minutes late by Sen. Tom Duane, D-Manhattan, the bill’s main sponsor. Duane, who is gay, told a group of supportive lawmakers and some two dozen gay couples from around the state that he believes the votes for passage are secure and that the measure will pick up additional votes when it hit the floor — “I would consider them to be gravy,” Duane said, before apologizing to any vegans in the audience.

Duane brushed off the idea that Smith might keep the measure from coming to the floor before the session ends later this month. “It’s coming to the floor, it’s passing,” he said.
